Travelling to Nepal by aeroplane
There are no direct flights from Europe, America, South Africa and Australia to Nepal, which can mean that a flight to Nepal must be operated as a connecting flight, it can be a stressful experience at times, especially when connections have long wait times. However, there are a large number of flights from other Asian countries that can fly to Nepal, so even if you cannot get a direct flight, you can quickly get a connecting flight.
Flights to Nepal are available from almost all Asian countries, with the emphasis on flights from China and India. Nepal is a popular destination for both Indian and Chinese, and since there are no entry requirements, especially from India, Nepal is a comfortable place to vacation.
Suppose you are coming to Nepal from a foreign country further away than the Middle East or Turkey (which is now part of Europe). In that case, It is best to travel through India or China as there are more connecting flights from these two countries than anywhere else in Asia. However, with more than 35 different airlines connecting more than 50 cities throughout Asia with Nepal, you have many options for your trip to Nepal.
Travel to Nepal by land
The overland journey to Nepal can only be made from China, via Tibet or from India, as no other countries are bordering Nepal.
Travelling by land can take a long time, but it can be an exciting experience as you have the opportunity to see many things you would not see when flying. Overland trips, especially from China through Tibet, are worth the experience and adventure they can provide.
From China, through Tibet to Nepal
When travelling from China to Nepal, one usually has to travel through the Tibetan Autonomous Region, as this is the only part of China that borders Nepal. To get to Nepal through Tibet, one must first make a reservation for Tibet, as no independent travel is allowed in the region, even for those who only cross the area to get to Nepal.
You have the option of leaving one of Tibet's seven gateway cities when you take the train to Lhasa and then travel to Nepal by land, or you can take a flight to Lhasa from one of the more than a dozen airports in China.
Once you arrive in Lhasa by plane or train, your journey across the Tibetan plateau begins. In general, the shortest trip from Lhasa to Nepal is around seven days. You should therefore include them in your travel plans. The advantage of a journey across the plateau to Nepal is that you can visit and see some of the most amazing places in the world, such as the Potala Palace, the Jokhang Temple, Gyantse Kumbum and even Mount Everest.
Once you arrive at the Nepalese border crossing at Kyirong port, north of Kathmandu, your tour ends, and your guide and driver will drop you off at the border crossing on the Chinese side of Resuo Bridge, the border crossing to Nepal.
On the other side, at the border post of Rasuwagadhi Fort, you can show your passport and visa to immigration officials or, if you do not already have one, apply for the Nepali visa upon arrival. It is a simple process for which you only need your passport, a passport photo, a completed application form and the corresponding fee. The visa at the border and the airport cost $25 for a 15-day visa, $30 for a 30-day visa and $100 for a 90-day visa. All visas are now multiple-entry, so you can travel back and forth as many times as you like for the duration of the visa.
Once you have passed the checkpoint, you will have to take the bus to Kathmandu, which runs several times a day, except during the monsoon, when you may have to wait for the next bus for some time. Buses from Rasuwagadhi Fort only go to Kathmandu, so if your final destination is another place, you will have to change buses in the capital of the country and take a connecting bus or a flight to your final destination.
From India to Nepal by land
If you are planning to travel to Nepal by land from India, you must have an international driver's license recognized by the Indian government or take a public bus. After that, any international driving license or a standard UK driving license can only be used for driving in India for a limited period. The rules on how long you can drive in India with an international driving permit vary from state to state but are never less than thirty days.
When travelling overland, entry into Nepal can be made through one of the six ports of entry, all of which have nearby railroad stations for rail travellers. For those travelling by bus, there are always buses connecting the nearest major city to the border crossing.
Kakarbhitta, located in the far east of Nepal, is the main point of entry for travellers from the northwestern Indian states of Sikkim and West Bengal. From the village on the Nepalese side of the border, some buses regularly go to Kathmandu and other places, and the bus station is within walking distance of the immigration office. If you want to fly to Kathmandu, there are regular flights from Bhadrapur, about 25 kilometres from Kakarbhitta.
Birgunj is the most popular border crossing for travellers to go to Kathmandu, as it is only a bus trip of six to eight hours. On the Indian side of the border is the Raxaul Central Station, which is easily accessible from anywhere in India and is known as the main crossing point into Nepal. Simara is 20 km from Birgunj and has an airport with flights to Kathmandu several times a day.
Belhia, in the district of Bhairahawa in western Nepal, is one of the most famous border crossings for Indian tourists, as it is near the small town of Lumbini, birthplace of Gautama Buddha. Belhia, one of the most important trade links between India and Nepal, is still more than 280 kilometres from Kathmandu, and the daily bus takes about 9 hours. However, flights from the local airport take only 30 minutes.
The other three border crossings, Mohana, GaddaChauki and Jamunaha, are also open for international tourists with on arrival visa service, but less popular due to their remoteness. Mohana and Gadd Chauki are located in the far west of Nepal; there are no flights to Kathmandu and buses take between 16 and 18 hours to get there. Jamunaha, located on the Nepalese side near Nepalgunj, is a major commercial port from India to Nepal and a popular transit point for Indian pilgrims. From the airport of Nepalgunj, there are flights to Kathmandu that take about 1 hour, while buses take between 12 and 14 hours to reach the Nepalese capital.

Travel insurance
A travel insurance policy for each itinerary of our company is a prerequisite for booking a holiday. You must have at least an emergency and repatriation insurance to cover the costs of rescue in the mountains. Carefully read the general conditions of your insurers, in particular, you must ensure that the following is included: 1) Activity (i.e., Tourism, hiking or mountaineering) 2) Maximum altitude reached during the trek 3) Evacuation by helicopter in case of emergency. It is essential to understand that you will be responsible for all expenses incurred in the evacuation and repatriation procedures and that it is your responsibility to pay the costs incurred in the event of an evacuation or medical treatment. You should be fully aware of the implications of arranging your travel insurance and understand the inclusion and exclusions of your policy. Physical condition and experience requirements
The Ruby Valley trek is suitable for passionate hikers who can walk for about 5-6 hours a day with a light backpack. Walking is relatively more comfortable for those who are used to walking at higher altitudes. We ask you to run and exercise regularly at least a few months before the start of the trip. Kathmandu to Syabrubesi (1503m / 4945ft)
You will start your Ruby Valley journey through a drive to Syabrubesi. We will be driving into Langtang National Park, where we must register our trek permits. The 7 to 8 hours scenic drive following the Trisuli Bazaar, Ramche Gaon, and Dhunche is undoubtedly a pleasant ride. The road is a bit narrow and rocky, but the alluring landscape will leave you in awe. We spend the night in Syabrubesi. Syabrubesi, being the midpoint of several treks and the border of China, has all the things you might require for the trek. We rest and relax at Syabrubesi and prepare for our hike the next day.
Overnight at Local Lodge
Trek from Syabrubesi (1,503m) via Chawatar (lunch) to Gatlang (2,337m)
Our destination for today is a small Tamang village called Gatlang. We follow a narrow and twisty trail to Bahun Dada Pass and then descend to reach Gatlang. We stop at Chawatar for lunch. The food is amazingly delicious here as most of the vegetables are freshly picked and locally grown. As we pass through this magnificent Tamang village, we witness the richness of their culture and tradition. We stay at Gatlang with the Tamang people. Their hospitality and food, without a doubt, will prove to be one of the best experiences you will ever get.

Trek from Gatlang (2,337m) to Parvati Kund, Yuri Kharka (lunch) to Somdang (3,271m)
We begin the hike from Gatlang to Parvati Kunda, a natural alpine freshwater lake. Named after the famous Hindu Goddess Parvati, the wife of Lord Shiva, this beautiful lake is also considered sacred by the local people. As you trek further ahead, the habitat and lodges decrease. However, you might come across very few tourists. We continue the trail through lush pine and rhododendron forest to Yuri Kharka.
After a delicious meal at Yuri Kharka, we hike towards the Somdang via Khurphu Bhanjyang. There is a shutdown mine, a few hours' walk from Somdang. Though the mine has not functioned for years, you can still take a look around and explore its astonishing beauty. In the past, this mine used to produce zinc, copper, tin, and crystals (including rubies). We will spend the night at Somdang Valley. The valley is so remote and silent you will literally find out what silence looks like.

Trek from Somdang (3,271m) via Pangsang Pass (3,842m) to Tipling (2,078m)
After waking up at Somdang, we enjoy a delicious breakfast. On this day, you will be passing through the Pangsang La Pass, which is a demanding, yet exciting trek. While appreciating the stunning mountains and spectacular landscapes, we head to the southwest of Somdang Village to reach Pangsang Kharka. Pasang Kharka is a large meadow that lies in Pangsang Pass. From Pasang Kharka, you can witness the panoramic views of Mount Manaslu and the Ganesh Himal Range. As one of the lesser-traveled trekking routes, there are relatively fewer homestays here. Then, we descend to Laptung village, passing through dense fir and rhododendron forests until we arrive at Tipling after a long trek.

Trek from Tipling (2,078m / 6,835ft) to Chalish Gaon (1,800m / 5,960ft)
Today's trek will be a short and relaxing one as we trek our way to the sister villages of Shertung and Chalish Gaon. First, we descend through the serene jungle, cross a tributary and reach Chalish Gaon, which lies in an idyllic setting. About 100m, above Chailsh Gaon, is Shertung village, and both of these settlements have a lot to explore. However, you can just choose to relax and enjoy the spectacular surrounding fields and lush valley below. Shertung and Chalish Gaon are inhabited mainly by Gurungs, Tamangs, and Dalits.

Trek from Chalish (1,800m) to Borang (1,700m), drive to Dhading Besi (580m)
A final day before you return to Kathmandu, you will enjoy all the wonderments of this trail. After a pleasant breakfast, we will hike further to Borang village then descend to Lishne Khola from Borang. From Borang, we take a local jeep to take us through a curvy road past Ankhu Khola and Kimdang Phedi Villages to Dhading Besi. As you return, you will see several peaceful settlements, which will make you nostalgic. We will be staying at Dhading Besi for the night.

Cancellation and Refund
If you cancel your trip with payment after booking, you will be charged as below:
Cancellation 30 (1 month) days before departure - 5%
Cancellation 15 - 29 days (3 - 4 weeks) before departure - 40%
Cancellation 07-14 days (2 weeks) before departure - 75%
Cancellation 07 or fewer days (less than a week) before departure: 100%
If you wish to make changes to your itinerary after confirming your reservation, you must inform us in writing at least 15 days before departure. 20% of the total cost will be charged to cover the cancellation costs of the reservation. The damages resulting from changing your reservation will be sent to you. Changes made 15 days or less before the departure date will be considered a cancellation of your original booking, and the indicated cancellation fees will apply.
Unused airline tickets, accommodation, or other travel activities, services, or features will not be refunded or compensated. There is a general reference to the itinerary for each adventure vacation, the accommodation used, the price, the passport and visa requirements, and the health procedures. As a guide, they are not a contractual obligation of the company. Changes may be made to some or all of them at any time, and we will notify you of changes that we become aware of as soon as reasonably possible. Most vacations have detailed itineraries that can be downloaded from our website or sent on request. We recommend that you read these instructions carefully before each reservation to ensure that you understand the type of vacation and what is and is not included in the price. If you have made a reservation and after reading the itinerary, you feel that you have not fully understood the details of the holiday; you can cancel your reservation without penalty. We can refund the full amount you have paid us. This type of cancellation is only allowed during the seven days after sending the travel routes. Such cancellation is not allowed if your reservation is made less than eight weeks before the start of the trip.
All tours of Tibet are conducted exclusively by the Tibet Tourism Authority. Our agents or we are not responsible for changes or cancellation programs due to unavoidable circumstances such as road closures, snow, political unrest, floods, flight cancellations, illnesses, late arrivals, or accidents or changes imposed by the Tibet Tourism Authority. Package Prices
The package cost is the cost stated for one of the trips, and all cost inclusions and exclusions are listed in the travel offer. These package prices are mainly based on land costs, airfares, and exchange rates. We try not to increase travel prices, but sometimes the price increase is beyond its control. We have a right to change the costs of your tour at any time without notice, including the departure date. The changes can be due to various reasons, e.g., B. Booking and Payment
To reserve your package, you must pay 25% of the total cost of the trip when booking the package. Please note that 25% of the total cost of the trip paid during the reservation is non-refundable. The amount must be paid to us 30 days before travel days. You can pay the remaining amount in cash or by bank transfer. We have the right to cancel your reservation without notice and a deposit refund if you do not pay before this date. Please also note that prices are in US dollars (USD).
The reservation must be made a minimum of 40 days before the start of the trip for individual trips. If you take a travel package to Bhutan and Tibet, you will have to pay 100% of the travel cost when booking the tour. You must send the form to our office via email (scanned copy) after you have signed it and 25% of the travel price.
Last-minute booking
The last-minute booking is intended for customers who, for many reasons, we're unable to book a regular trip. However, you would like to confirm your travel reservation in no time. We established special booking provisions for trips to Nepal. Your last minute reservation is accepted with 100% of travel costs within 24 hours. Note
If you wish to extend your trip for up to one year without cancellation, you must notify us by email at least two weeks before the start of the journey. You must also pay the additional amount if the cost of the trip increases due to increases in various things.
Your deposit and payments will be fully refunded when we cancel your trip. However, the reasonable cost we compensate for your trip will be deducted from your deposit if we cancel your trip due to a civil war, natural disaster, or other unpredictable natural or artificial circumstance that is beyond our control.
Passport & Nepal Visas
Travelers must have a valid passport that is valid for at least six months from the date of return. You can obtain your Nepal visa upon arrival at Tribhuvan International Airport or the Nepalese embassies or consulates in your country. It is your responsibility to obtain a Nepalese visa.
Note: Residents of countries such as Nigeria, Ghana, Afghanistan, Zimbabwe, Somalia, Cameroon, Swaziland, Iraq, Ethiopia, Liberia, and Palestine do not receive a visa at the entry point for Nepal.
Travel Insurance
Our company pays insurance for all our employees (Trekking guides, porters, Sherpa, and driver). But clients must manage their insurance themselves. Clients must send us their insurance documents before traveling.
Acceptance of Risk and Liabilities

Please understand that adventure vacations are associated with certain dangers that you have to accept at your own risk. The company is not responsible for any illness, injury, or death that may have occurred during a trip, trekking, or tour other than negligence or liability for uninsured loss of your property. We are not responsible for any loss, damage, or accident in the luggage or items that are transported at any time at their own risk, even if they are carried by porter or pack animals.
Health and Fitness Condition
The traveler must be in good health and good physical shape. You must tell us before you leave if you have any medical problems. We generally organize our trips in remote areas where you may not have regular medical services or hospital facilities. Evacuation can be lengthy, complicated, and expensive if necessary. Please note that medical costs and evacuation costs are the responsibility of the traveler.
Tour Leader Authority
If you have signed our reservation form, this underlines your acceptance to accept the authority of the tour guide representing. The leader of behavior, itinerary, and travel destinations is crucial. If the leader determines that their behavior or physical condition is not safe for the safety, health, and well-being of other group members, they may be asked to leave the trip. You are not entitled to a refund for unused services if the manager makes this decision.

On the first three days of your Trek, you will not have any difficulty, however, on your fourth day of travel; you will face with altitude sickness as you have to cross the Pangsang La pass, which is located at an altitude of 3,850 meters above sea level. The area is also one of the least explored in Nepal, so there is less chance of meeting other travelers. However, you may encounter some wildlife. You will witness several impressive landscapes and the amazing culture and traditions of the Gurung and Tamanags community, which makes the trip especially worthwhile.
After passing the Pangsang La pass, the route is not that difficult. You will have to climb and descend several hills on your journey. You will be covered for the most part by pine and rhododendron forests. In spring you will experience the beautiful rhododendron blossom for most of your walk. Besides the Pansang La Pass, you also have to cross the Khupra Bhanjyang Pass before you reach Somdang.

By accessing or using our website or making a booking through our marketplace, you acknowledge that you have read and agree to these terms of use. We may amend these terms at any time and reserve the right to make changes and improvements to the marketplace at any time without incurring any liability from you. If you continue using the marketplace after these terms have been amended, you agree to the amended terms. If you do not wish to accept the changes, you can stop using the marketplace.
We recommend that you carefully read these terms and conditions so that you fully understand your rights and responsibilities related to the use of the Activ Retreat marketplace.
While using this marketplace, you can view listings from retreat hosts ("Hosts") and request to book ("Bookings") for the available sessions. By placing a booking for a retreat or host rental through this service, All bookings are subject to a deposit (“Deposit”). Once you have selected a trip, made a reservation, provided your personal information and your booking has been accepted by your host, you will enter into a binding contract with the host of the trip. While Activ Retreats will try to assist you in resolving any issues that may arise between you and the host, we cannot be held responsible for any problems that arise, whether before or during your Retreat. If you have any questions, complaints, or comments about a host, listing, booking or deposit, you can contact Activ Retreats through the marketplace at support@activretreats.com.
All listings, agreements and policies encompassed in these listings are subject to the host's terms and conditions. Activ Retreats is not a party to any agreement between yourself and a Host. We recommend that you carefully read each host’s terms and conditions. Activ Retreats is not responsible for any decisions you make based on the information provided by Activ Retreats or that of our hosts on the marketplace, unless stated otherwise in these terms of use.
Additionally, you acknowledge and agree that You are not allowed to use our marketplace for any inappropriate activities such as spreading viruses, hacking, spamming, damaging, deleting or making our marketplace inaccessible. You are not allowed to use manual or automated software or processes to crawl or scrape the marketplace or reproduce, decompile or reverse engineer it. All users must additionally adhere to our security measures and not circumvent these.
Hosts may not list retreats, events, products, or services that violate any applicable laws or regulations. . Activ Retreats reserves the right to modify a listing at our discretion in order to improve visibility, appeal, and ranking. This may include editing the title, correcting grammar and punctuation, rearranging sections, images, and text, and similar actions. We also reserve the right to suspend or terminate your use of the marketplace at our discretion and without cause. Misrepresentation of a Retreat or Property is not permitted by Activ Retreats and is immediate grounds for your listing to be removed and your access to the Services to be terminated.
We are constantly updating Our listings. The retreats and host rentals available on Our Service may be mispriced, described inaccurately, or unavailable, and We may experience delays in updating information regarding our retreats on the Service and in Our advertising on other websites.
We cannot and do not guarantee the accuracy or completeness of any information, including prices, product images, specifications, availability, and services. We reserve the right to change or update information and to correct errors, inaccuracies, or omissions at any time without prior notice.
If You wish to book a retreat or host rental available on the Service, You may be asked to supply certain information relevant to Your booking including, without limitation, Your name, Your email, Your phone number, Your credit card number, the expiration date of Your credit card, Your billing address, and Your shipping information. In addition, you may be asked to verify that you are physically and emotionally capable of participating in the Retreat.
You represent and warrant that: (i) You have the legal right to use any credit or debit card(s) or other payment method(s) in connection with any Order; and that (ii) the information You supply to us is true, correct and complete.
By submitting such information, You grant us the right to provide the information to payment processing third parties for purposes of facilitating the completion of Your booking.
When You create an account with Us, You must provide Us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of Your account on Our Service.
You are responsible for safeguarding the password that You use to access the Service and for any activities or actions under Your password, whether Your password is with Our Service or a Third-Party Social Media Service.
You agree not to disclose Your password to any third party. You must notify Us immediately upon becoming aware of any breach of security or unauthorized use of Your account.
You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than You without appropriate authorization, or a name that is otherwise offensive, vulgar or obscene.
We may terminate or suspend Your Account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms and Conditions.
Upon termination, Your right to use the Service will cease immediately. If You wish to terminate Your Account, You may simply discontinue using the Service.
Bookings and Listings
Listing rentals or retreats on our marketplace is FREE. Hosts set their own fees for their retreats and host rentals. If you make a booking, you may be responsible for paying a portion of the fee to the organizer. We have no involvement in or liability for your payment of reservations.
On the marketplace, you can view prices for the retreats and host rentals in different currencies. These conversions are estimates. At the time of payment, the price of the retreat and or host rental will be converted in real-time to the currency specified by the organizer. This may differ from the amount displayed earlier. The price displayed after this real-time conversion will be the final amount due for the reservation. The marketplace may require payment in the user's national currency and may charge a conversion fee for this.
The payment terms for bookings are set by the hosts, and the currencies and payment methods available may vary. Activ Retreats is not responsible for these payment terms or any rights derived from currencies.
Payment cards (credit cards or debit cards) are subject to validation checks and authorization by Your card issuer. If we do not receive the required authorization, We will not be liable for any delay or non-delivery of Your booking experience.
We pay all partners and hosts via Stripe.
We reserve the right to refuse or cancel Your booking at any time for certain reasons including but not limited to:
We reserve the right to refuse or cancel Your booking if fraud or an unauthorized or illegal transaction is suspected.
In the event that Activ Retreats brings a customer to you who successfully books your retreat or venue via our marketplace or directly on your site after visiting Activ Retreat, you will be required to pay a commission of 10% on the total price of the booking unless otherwise agreed to with Activ Retreats. This commission will be collected as a deposit from the customer at the time of booking, and the remaining balance will be transferred to you after deducting a payment processing fee. Please note that this commission applies to all bookings and rentals made through our marketplace and to referrals. If a customer is referred to you by Activ Retreats, you are also required to pay a 10% commission on the total price of the booking unless otherwise agreed to with Activ Retreats.
If you wish to challenge a commission charge, please contact us at support@activretreats.com. We will investigate this to determine the original source of the lead and, if necessary, make adjustments. If you believe you received a lead from a different source prior to a customer’s engagement with Activ Retreats, you may provide a copy (or screenshot) of the dated communications as proof.
Any Promotions made available through the Service may be governed by rules that are separate from these Terms.
If You participate in any Promotions, please review the applicable rules as well as our Privacy policy. If the rules for a Promotion conflict with these Terms, the Promotion rules will apply.
The Company is not responsible for the content of the Service's users. You expressly understand and agree that You are solely responsible for the Content and for all activity that occurs under your account, whether done so by You or any third person using Your account.
You may not transmit any Content that is unlawful, offensive, upsetting, intended to disgust, threatening, libelous, defamatory, obscene or otherwise objectionable. Examples of such objectionable Content include, but are not limited to, the following:
The Company reserves the right, but not the obligation, to, in its sole discretion, determine whether or not any Content is appropriate and complies with these Terms, refuse or remove this Content. The Company further reserves the right to make formatting and edits and change the manner of any Content. The Company can also limit or revoke the use of the Service if You post such objectionable Content. As the Company cannot control all content posted by users and/or third parties on the Service, you agree to use the Service at your own risk. You understand that by using the Service You may be exposed to content that You may find offensive, indecent, incorrect or objectionable, and You agree that under no circumstances will the Company be liable in any way for any content, including any errors or omissions in any content, or any loss or damage of any kind incurred as a result of your use of any content.
Although regular backups of Content are performed, the Company does not guarantee there will be no loss or corruption of data.
Corrupt or invalid backup points may be caused by, without limitation, Content that is corrupted prior to being backed up or that changes during the time a backup is performed.
The Company will provide support and attempt to troubleshoot any known or discovered issues that may affect the backups of Content. But You acknowledge that the Company has no liability related to the integrity of Content or the failure to successfully restore Content to a usable state.
You agree to maintain a complete and accurate copy of any Content in a location independent of the Service.
To the maximum extent permitted by applicable law, IN NO EVENT SHALL THE COMPANY OR ITS SUPPLIERS BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA OR OTHER INFORMATION, FOR BUSINESS INTERRUPTION, FOR PERSONAL INJURY, LOSS OF PRIVACY arising out of or in any way related to the use of or inability to use the Service, third-party software and/or third-party hardware used with the Service, or otherwise in connection with any provision of this Terms), even if the Company or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose. Notwithstanding any damages that You might incur, it is understood that Activ Retreats is not an insurer, that insurance if any shall be obtained by You and that if Activ Retreats should be found liable for any loss, damage or injury relating to the Service, its likability shall be limited to a sum equal to the cost YOU paid to Activ Retreats.
Some jurisdictions do not allow the exclusion of implied warranties or limitation of liability for incidental or consequential damages, which means that some of the above limitations may not be deemed to apply. In these jurisdictions, each party's liability will be limited to the greatest extent permitted by law.
By using our marketplace, the Host agrees to defend and hold harmless Activ Retreats, its affiliates, employees, agents, contributors, third party content providers, insurers and licensors from any third-party actions, claims, demands, liabilities, costs, expenses (including legal fees), losses, or damages that arise from a Host’s content, use of our Services or the Retreat.
It is further agreed that should You cause any damages, whether direct or indirect, to the HOST that you shall indemnify and hold harmless Activ Retreats from any and all claims, damages, losses, demands, liabilities, costs and expenses (including legal fees) arising from your negligence, whether by conduct or omission, during the Retreat.
The Service is provided to You "AS IS" and "AS AVAILABLE". Without limitation to the foregoing, the Company provides no warranty, and makes no representation of any kind that the Service will meet Your requirements, achieve any intended results.
Without limiting the foregoing, neither the Company nor any of the company's provider makes any representation or warranty of any kind, express or implied: (i) as to the operation, availability and experience of the Service; or (ii) that the Service, its servers, the content, or e-mails sent from or on behalf of the Company are free of viruses, scripts, trojan horses, worms, malware, timebombs or other harmful components.
Some jurisdictions do not allow the exclusion of certain types of warranties on applicable statutory rights of a consumer, so some or all of the above exclusions and limitations may not apply to You. If such dispute has not been settled within sixty (60) days after a request for mediation has been submitted, the matter can proceed to the Courts of California.
If You are a European Union customer, you will benefit from any mandatory provisions of the law of the country in which you are resident in.
You represent and warrant that (i) You are not located in a country that is subject to the United States government embargo, or that has been designated by the United States government as a "terrorist supporting" country, and (ii) You are not listed on any United States government list of prohibited or restricted parties.
If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.
Except as provided herein, the failure to exercise a right or to require performance of an obligation under these Terms shall not affect a party's ability to exercise such right or require such performance at any time thereafter nor shall the waiver of a breach constitute a waiver of any subsequent breach.
